In a written reply to his January 29 representation, the Investigating Officer, an ACP of Jubilee Hills, said a notice under Section 160 of the Cr.P.C. had been duly served at Rao’s Banjara Hills residence as per records, including his election affidavit and Assembly documents, and that he had responded after receiving it.
The police said that while Section 160 allows examination within the jurisdiction of the concerned or adjoining police station, they had already offered to conduct the examination at his residence in view of his age and the statutory proviso. Mr. Rao had sought that the examination be held at Erravelli village in Markook mandal of Siddipet district, which the police declined, saying the venue must correspond to the ordinary place of residence in official records.
The reply also cited administrative difficulty in transporting sensitive electronic and physical records to the village location, reiterating that the examination would be held at his Hyderabad residence on the specified date and time.
