Tamil Nadu Chief Minister MK. Stalin on Friday opposed the exemption of atomic mineral mining from public session and urged Prime Minister Narendra Modi to withdraw the workplace memorandum issued by the Union Ministry of Environment, Forest and Climate Change.

Tamil Nadu’s coastal districts are endowed with deposits of Rare Earth Elements embedded in seaside sand techniques, and these coasts are ecologically fragile and extremely weak, he mentioned.

“Policy modifications of such significance should be deliberated transparently in Parliament and State Legislatures, with due session of the States and members of the general public. Proceeding in any other case would run counter to the spirit of cooperative federalism and the democratic ethos of our nation,” Mr. Stalin mentioned in his letter to Mr. Modi.

Nesting grounds

The seashores of the Gulf of Mannar and the Palk Bay are residence to the nesting grounds for the endangered turtles, coral reefs, mangroves, and sand-dunes that function pure obstacles towards erosion and cyclonic occasions, he mentioned.

“These ecosystems maintain biodiversity, stabilise shorelines, sequester carbon, and safeguard coastal communities. Mining in such areas is due to this fact inherently eco-sensitive and calls for rigorous scrutiny with the fullest involvement of native communities,” Mr. Stalin mentioned.

According to the September 8 workplace memorandum, issued by the Impact Assessment Division of the Union Ministry of Environment, Forest and Climate Change, public session is just not required for the tasks for mining of atomic minerals, notified in Part B, and demanding and strategic minerals, notified in Part D, of the First Schedule of the Mines and Minerals (Development and Regulation) Act.

Exempting tasks from public session would deprive native communities of their proper to lift reliable issues referring to livelihood loss, displacement, and environmental impacts, and would weaken the ideas of participatory democracy.”

The workplace memorandam additionally raised “severe authorized issues,” Mr. Stalin mentioned, recalling that the National Green Tribunal had up to now struck down workplace memoranda which sought to dilute statutory safeguards. The Supreme Court, in Alembic Pharmaceuticals Ltd. v. Rohit Prajapati & Ors. (2020), had held that substantive amendments to the EIA framework couldn’t be caused by means of govt directions akin to workplace memorandum, and that such devices couldn’t override statutory notifications, he identified.

“The current workplace memorandum… quantities to an impermissible govt modification of regulation and is due to this fact unsustainable,” Mr. Stalin mentioned. sHe additional reiterated Tamil Nadu’s dedication to contributing to the nation’s strategic and defence necessities, because it had all the time achieved up to now.
