In September, the five-judge Bench headed by Chief Justice of India B.R. Gavai had reserved judgment and made it clear that the Centre shouldn’t count on the apex court docket to “sit idle” and powerless if a constitutional authority did not discharge his duties.

The Union Government had used the platform of the Presidential Reference, made in May, to query the Supreme Court for encroaching on the domains of the Governors and the President. The bone of competition was an April 8 judgment which imposed a three-month deadline on coping with Bills positioned for assent or consideration.

What is a Presidential reference? | Explained
The advisory jurisdiction of the Supreme Court underneath Article 143 is a relic of the Government of India Act, 1935. It vested the Governor-General with discretionary energy to refer any query of legislation of public significance to the federal court docket for its opinion.An identical provision is out there within the Canadian structure. This mechanism permits the Supreme Court of Canada to supply opinions on authorized questions referred to it by the federal or provincial governments. T.N. moved Supreme Court towards Governor reserving Kalaignar University Bill for Presidential reference
The Tamil Nadu authorities moved the Supreme Court on Saturday (October 4, 2025) towards a call of Governor R.N. Ravi to order the Kalaignar University Bill 2025 for consideration of President Droupadi Murmu as an alternative of granting assent to proposed legislation as suggested by the State Cabinet.The State authorities, represented by senior advocate P. Wilson and advocate Misha Rohatgi Mohta, has sought an order from the highest court docket to declare the Governor’s determination and “all consequential acts arising therefrom” as unlawful, patently unconstitutional, and void ab-initio.
