Additional Session Judge Ekta Gauba Mann of Tis Hazari Court ordered framing of charges against the two. They were under various sections for attempt to murder, criminal conspiracy, and obstruction of public servants.
According to police, Ms. Gupta was attacked by accused Mr. Khimjibhai on August 20 during public hearing at her official residence in Civil Lines. She received injuries on her head i.e. temporal region and there was a nasal bleed and lip injury, CM’s medical report stated.
Police took the accused in custody immediately after the attack.
During interrogation, the accused claimed that he, being a dog lover, was annoyed with the Supreme Court’s order on catching of stray dogs and keeping in shelter homes in Delhi, hence he decided to attack Ms. Gupta out of frustration. Police also claimed to have found that the accused was instigated by Mr. Raza, his friend.
Police claimed that conspiracy has been found through call detail records, locations, and money transactions. It is alleged that videos of Chief Minister Rekha Gupta’s home and the public hearing venue were shared before the attack.
Charge sheet against both accused was filed on October 18th.
“Considering the fact that the defence taken by accused Rajesh that he is a dog lover and he was upset by the order of the Supreme Court of India. But, he attacked upon the victim who has neither passed any such order and who has no role to play in the said order passed by the Supreme Court of India. Also, the accused Rajesh was not a Delhi resident and he has no locus to go to the Delhi Chief Minister for his grievance against the judicial order of Highest Court of India. This shows that the defence taken by the accused Rajesh does not appease to the prudent mind,” the court said while framing charges against the accused.
The Sessions Court has already rejected the regular bail plea of co-accused Syed Taseen Raza.
The case will be heard on December 26th.
