Umar Khalid, other accused are seeking bail after five years in jail as undertrials; Delhi police say violence was pre-planned

Meanwhile, earlier on November 21, 2025, the Delhi Police had vehemently objected to pleas claiming that they only cite the Constitution for the sake of getting bail.

In the previous hearing, Additional Solicitor General S.V. Raju for the Delhi Police described how the violence unfolded during the 2020 Delhi riots, before a Bench of the Supreme Court comprising Justices Aravind Kumar and N.V. Anjaria on Friday (November 21, 2025). Citing statements from a protected witness, Mr. Raju said that conspirators planned violence, organised chakka jams to disrupt and “choke Assam out of India,” and further mobilised rioters armed with sticks, who engaged in heavy stone-pelting.

In the hearing held on November 21, 2025, the Delhi Police had vehemently objected to pleas for bail filed by former Jawaharlal Nehru University student leader Umar Khalid and others accused under the Unlawful Activities (Prevention) Act in the 2020 Delhi riots ‘larger conspiracy’ case, claiming that they only cite the Constitution for the sake of getting bail.“These are people with scant regard for the Constitution. Only for bail, they will quote Article 21 (fundamental right to life and personal liberty) of the Constitution,” said Additional Solicitor General S.V. Raju, appearing for the Delhi Police. He was addressing a Supreme Court Bench headed by Justice Aravind Kumar in the concluding remarks of his response to the bail petitions.
