Rejecting Ms. Lamba’s plea seeking discharge in the case, Rouse Avenue Courts Additional Chief Judicial Magistrate, Ashwani Panwar, charged her with the offence related to assault on public servants, obstructing government officials and disobedience of a lawful order.
The prosecution has submitted to the court that the protest was organised even as prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita were in force in the area surrounding Jantar Mantar Road, and permission to march towards Parliament was denied.
The prosecution further stated that the accused and the protesters pushed the female and male police officials, jumped the barricades, and some of them even blocked the road opposite Free Church by lying on the main road, which hindered the public’s right of way.
The court noted that the charges were framed against the accused after she was clearly seen committing the ‘acts’ mentioned in the FIR, as shown in videos of the spot played in court by the police.
“Perusal of the said videos reveals that the accused, along with her supporters, was present at the place where the incident in question took place. The accused was seen pushing the police officials present at the scene. The accused jumped the first as well as the second barricade and thereafter, she vanished into thin air, leaving the other protesters in the lurch,” the court noted.
